Terms and Conditions

This Agreement is entered into between RevSquared LLC, henceforth referred to as the "Seller", and any individual or entity, henceforth referred to as the "Buyer", who purchases products from the Seller’s store on Shopify.

ACCEPTANCE OF TERMS

By purchasing any product from the Seller's store on Shopify, the Buyer agrees to be bound by these Terms and Conditions, as well as any other policies stated on the Seller's store, including but not limited to, the Return and Refund Policy, and the Privacy Policy.

PRODUCT DESCRIPTIONS

The Seller endeavors to describe and display its products as accurately as possible. However, the Seller does not guarantee that the product descriptions, images or other content is accurate, complete, reliable, current, or error-free. If a product received is not as described, the Buyer's sole remedy is to return the product in unused condition as per the Return and Refund Policy.

PRICING

All prices are listed in the currency stated on the Seller’s store and are exclusive of applicable taxes, shipping, and handling charges, unless otherwise stated.

PAYMENT

Payment is due at the time of order. The Buyer will be charged the total amount of the order, including taxes, shipping and handling charges, at the time of purchase. The Seller reserves the right to change prices, including shipping and handling charges, at any time, but changes will not affect orders already placed and confirmed.

SHIPPING AND DELIVERY

The Seller will use reasonable efforts to ship the products within the timeframe indicated at the time of purchase. However, shipping dates are estimates and are not guaranteed. The Seller is not liable for any delays in shipment or delivery.

RETURNS AND REFUNDS

The Buyer may return the product as per the Return and Refund Policy stated on the Seller's store. The Seller reserves the right to refuse returns or to charge a restocking fee for any product.

WARRANTY

The Seller provides a warranty for its products as stated in the product description or as provided separately in writing. This warranty does not cover damage caused by improper use, normal wear and tear, or damage caused by third parties.

LIMITATION OF LIABILITY

In no event shall the Seller be liable for any indirect, special, incidental, or consequential damages, including, but not limited to, loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of the Seller’s products, services, or these Terms and Conditions.

INDEMNITY

The Buyer agrees to indemnify, defend, and hold harmless the Seller, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating in any way to the Buyer's use of the Seller’s products or services.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Illinois, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms and Conditions will be brought exclusively in the courts located in Illinois, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

CHANGES TO TERMS AND CONDITIONS

The Seller reserves the right to change these Terms and Conditions at any time without notice. The most current version of these Terms and Conditions will be posted on the Seller's store on Shopify.

SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

ENTIRE AGREEMENT

These Terms and Conditions, along with the policies referenced herein, constitute the entire agreement between the Buyer and the Seller and supersede all prior agreements and understandings, whether written or oral, with respect to the subject matter hereof.
